Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Shadow Echo mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a binding legal agreement between you ("User", "you") and the developer of Shadow Echo ("we", "us", "our"). They incorporate our Privacy Policy by reference.

2. Eligibility

Shadow Echo contains fictional depictions of crime, violence, and mature themes and is intended for players aged 16 and above. You must be at least 16 years old to use the App. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded products that you own or control, solely for your personal, non-commercial entertainment, subject to these Terms and the Apple Media Services Terms and Conditions.

4. Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract source code from the App, except as permitted by applicable law;
• Modify, adapt, translate, or create derivative works of the App;
• Copy, redistribute, sublicense, lease, rent, or sell the App or any part of it;
• Use automated tools, bots, scripts, or scrapers to interact with the App or our servers;
• Attempt to bypass, disable, or interfere with security features including device integrity verification, abuse prevention measures, or content moderation;
• Use the App to transmit unlawful, harassing, defamatory, obscene, or otherwise objectionable content;
• Attempt to extract, manipulate, or alter the intended behavior of the AI characters through any technical or linguistic technique;
• Use the App in any way that violates applicable laws or regulations.

5. AI-Generated Content

• AI-generated responses may be inaccurate, offensive, or inconsistent despite our content moderation efforts.
• AI characters do not represent real persons. Any resemblance to real individuals, living or dead, is coincidental.
• AI-generated content is for entertainment only and should not be relied upon as factual, legal, medical, financial, or professional advice.
• We are not responsible for AI outputs that may arise from unforeseen interactions with the language model.
• You are responsible for your inputs to the AI. Do not submit personal information, confidential data, or content that violates these Terms.

6. User Conduct and Content

When interacting with AI characters, you must not submit content that:

• Contains sexually explicit material, hate speech, or encouragement of self-harm;
• Promotes illegal activity, violence, or harm to others;
• Infringes intellectual property, privacy, or other rights of any third party;
• Contains malicious code or attempts to destabilise the service.

We automatically filter inputs and outputs for policy violations. Violating content may be blocked, and repeated abuse may result in temporary or permanent restrictions on your device's access to the service.

7. In-App Advertising

Shadow Echo is supported by rewarded video advertisements provided by Google AdMob. You may watch ads voluntarily to unlock cases, earn extra gameplay turns, and access bonus content. Ads are not mandatory to complete the core gameplay, but some optional features require viewing ads. Ad availability depends on inventory and your network connection.

8. No In-App Purchases

Shadow Echo does not currently offer in-app purchases. All content is unlocked through gameplay progression or by watching rewarded ads. This may change in future versions; any introduction of paid content will be subject to additional terms and Apple's in-app purchase system.

9. Intellectual Property

All content in the App, including but not limited to case scenarios, character designs, artwork, music, sound effects, source code, and trademarks, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

User-generated dialogue inputs are used solely to generate gameplay responses and are not retained beyond the session (see our Privacy Policy). You grant us a limited licence to process your inputs for the purpose of operating the App.

10. Service Availability

The App requires an internet connection and our backend services to function. We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time without notice. We are not liable for any loss of game progress or access resulting from service interruptions.

11. Updates and Changes

We may release updates to the App and may modify these Terms from time to time. Material changes will be posted in the App or on this page with an updated date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP (WHICH, FOR A FREE APP, IS ZERO).

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your misuse of the App, violation of these Terms, or infringement of any third-party rights.

15. Termination

These Terms remain in effect until terminated. We may terminate or suspend your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your licence to use the App ends and you must stop using and uninstall the App. Sections 9, 12, 13, 14, and 16 survive termination.

16. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts located in Alberta, Canada, except where prohibited by the laws of your jurisdiction.

17. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement, which is incorporated into these Terms by reference. You can read it here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
